Biden vil tjekke ‘extreme’ dommere – er det på tide med en retsreform?

Præsident Biden tager bladet fra munden og foreslår store reformer for Højesteret! Kan det virkelig få konsekvenser for dommernes magt?

I en tale i Austin, Texas, satte præsident Joe Biden fokus på Højesterettens sammensætning og relevante reformer, der kunne ændre, hvordan denne centrale institution fungerer. Med udgangspunkt i den nuværende politiske kløft og udfordringerne, som Højesteret har stået over for, foreslo han at indføre terminsgrænser for dommerne samt en håndhævelig etisk kodeks. Dette initiativ er ikke kun for at snarere Højesteret op, men også for at genopbygge folks tillid til retssystemet, der i mange år er blevet beskyldt for at være alt for politiseret.

"Vi er ved at nå et punkt, hvor Højesterettens beslutninger påvirker livet for almindelige borgere mere end nogensinde før," sagde Biden. Han påpegede også nødvendigheden af at indføre en konstitutionel ændring, der vil begrænse præsidentens magt, i kølvandet på den kontroversielle dom, der gav tidligere præsident Donald Trump immunitet overfor retsforfølgelse. Kamala Harris har givet sin støtte til Bidens forslag og understreget, at grundlæggende reformer er nødvendige for at sikre retfærdighed.

Selvom nogle ser Bidens forslag som et langskud, kunne det faktisk ende med at være en game-changer. Mange juridiske eksperter mener, at Højesterettens strukturelle regler, herunder livstidsudnævnelser, gør den modstandsdygtig overfor forandringer. Men hvis Biden får flertal bag sig, står det hurtigt klart, at Højesterettens magt kan være i fare, og at reformer kan komme på dagsordenen.

For at give lidt ekstra perspektiv på situationen, er det værd at bemærke, at USA's Højesteret kun har gennemgået betydelige reformer én gang siden sin oprettelse i 1789. De seneste 30 år har vi desuden set en stigende politisering af dommerne, hvilket har betydet, at mange amerikanere nu mener, at Højesteret skal reformeres. Et interessant faktum er, at tidligere præsident Franklin D. Roosevelt også forsøgte at ændre Højesterettens opbygning i 1937, hvilket dog blev mødt med stor modstand. Det vil være interessant at se, hvordan Biden vil klare sig i denne politiske forhindringsbane.
