Could F.B.I. Inquiry Result in Barring Trump From Office? What to ... (The New York Times)

WASHINGTON — The F.B.I. search of former President Donald J. Trump's residence in Florida has raised the question of whether the criminal investigation ...

“Yes, I recognize the legal challenge that application of this law to a president would garner (since qualifications are set in Constitution),” Mr. Elias wrote. After the Mar-a-Lago search warrant came to light, one of the most prominent voices pointing to Section 2071 was that of Marc Elias, who served as general counsel for Mrs. Clinton’s 2016 campaign. Justice John Paul Stevens wrote that the state had no power to add qualifications to the list of eligibility criteria established by the federal Constitution. In a 1969 case, the Supreme Court rejected an attempt by the House of Representatives, by majority vote, to block Adam Clayton Powell Jr. from taking his seat; voters in his district had re-elected him despite allegations of misconduct. Mrs. Clinton was never charged with any crime related to her use of the server. Notably, the Constitution does authorize Congress to render people ineligible to hold federal office as a penalty for convictions in impeachment proceedings. If convicted under that law, defendants can be fined up to $2,000 and sentenced to prison for up to three years. But there is reason for caution before concluding that if Mr. Trump were to be charged and convicted under that law, he could not legally return to the White House even if voters wanted him to. Early reports citing sources familiar with the matter have indicated that the criminal investigation behind the search warrant relates to suspicions that Mr. Trump unlawfully took government files with him when he left the White House. Section 2071 is not limited to classified information. There are several laws that could potentially cover such a situation. But by its nature, the warrant means a criminal investigation is underway.

A federal law on removing records is unlikely to disqualify ex-president Donald Trump from a second term in the White House, experts say.

Legal experts told USA TODAY that while the law has yet to be litigated, it almost certainly wouldn't apply to the presidency. - Exclusive criteria: “I don’t think Trump can be disqualified by this law from being president. But I think there’s a real doubt that the disqualification provision would apply to the office of the presidency.” I don’t think it’s been decided. Mar-a-Lago document inquiry is one of many. Experts are dubious, as they were in 2015.

It is state property, but more importantly, its current use and its history of use for 150 years have been one of essentially a park. A landscape project like this has a price tag of about $300,000 to $350,000. “There were really no places that you could sort of use as a public park,” Everhart said. There will also be a new interpretive path lining the fence accompanied by an ADA-accessible pathway.

The Scranton office was shot in one building and the Stamford office was shot in another with a big parking lot in between the two. "[Producer] Kent Zbornak told me that NBC Universal I.T. came out, and they first they had to hook up the phone lines from these two buildings so that John and I could talk to one another. Jim calls the Scranton office after hours to leave Kevin ( Brian Baumgartner) a message about fantasy football, but Pam was still there and picked up the phone. Case in point, in season three, an important episode featuring a pivotal scene between Jim and Pam was entrusted to an inexperienced director. But a heartfelt episode in between that time gave fans just enough to quench their thirst for the potential of the two finally getting together. "The Office" wasn't shy at pushing the envelope.

Trump disqualified from holding office? Clinton-linked lawyer points ... (Washington Examiner)

Marc Elias suggested the media was missing point about the FBI raid, suggesting it could lead to Donald Trump being barred from holding office.

It is prosecutorial misconduct, the weaponization of the Justice System, and an attack by Radical Left Democrats who desperately don’t want me to run for President in 2024.” The agency also asked the Justice Department to investigate whether Trump had violated federal law with his handling of records. "So this could be the whole enchilada in terms of DOJ resolution," he said. After legal scholars pushed back on the assertion, particularly with the view that applying the statute to presidential candidates would be unconstitutional, Mukasey walked back his comments. The National Archives and Records Administration said presidential records in 15 boxes obtained from Mar-a-Lago earlier this year included materials marked as classified national security information. Such reporting had Marc Elias, the top lawyer for Hillary Clinton’s 2016 presidential campaign who has drawn scrutiny for his role in pushing Trump-Russia collusion claims, pointing to U.S. Code Title 18, Section 2071.
