Cadet whose rape claim shook up the shipping industry sues Maersk (Business Insider)

Insider spoke to Hope Hicks, the cadet known as "Midshipman X" who has gone public with allegations she was raped aboard a Maersk ship.

"And I'm just hoping that it gives others the ability to come forward as well." "Just because the crew changes, doesn't mean it's not going to happen to somebody else," she said. And there, the scale of the problem really opened up, she said. "It has really changed the trajectory of her future," Dunn said. "I had all these young girls at my school come forward to me, not only about sexual assault ... but sexual harassment and just making them feel like they aren't even human anymore," she said. Among the changes that followed was that USMMA issued satellite cellphones to all cadets. "Hope was a virgin who planned to abstain from sex until marriage," the complaint says. Then, to her surprise, he suggested that she might "want to make something work," it alleges. The first engineer knew of her intoxicated state, the complaint says. It said that Hicks took part reluctantly, and, fearing the ship's strict command structure, felt "forced" to consume 8-10 shots of hard liquor over a short time, before passing out. Hicks was the only female on board the MV Alliance Fairfax during her Sea Year, the complaint says. Hicks has not named her alleged rapist, and it is unclear if the first assistant engineer who was fired is the same person as the first engineer accused in the lawsuit.

The USMMA cadet known as Midshipman X has now revealed that she is Hope Hicks and has filed suit against Maersk Line Limited.

According to the complaint, Maersk’s indifference to its duties was evident when one of Hicks’ Maersk supervisors tasked her with logging onto a computer and completing the required sexual assault and harassment training on behalf of a number of other crew members. “But, today, Hope is publicly identifying herself in an effort to seek justice for the sexual assault and harassment that she, and others – like Midshipman-Y, endured aboard Maersk vessels.” According to both complaints, Maersk was aware of the prevalence of sexual assault and harassment on its ships. According to the complaint, Hicks suffers from severe and ongoing emotional distress as a result of the traumatic events she experienced on the Maersk vessel. According to the complaint, when Hicks confronted the officer, she was told no one would believe her if she made a report. Sanford Heisler Sharp notes that the USMMA Sea Year Program requires, as a precondition to graduation, that students work on commercial ships for months at a time to gain practical shipboard experience.

After the publication of Hicks' account, U.S. Secretary of Transportation Pete Buttigieg suspended the Sea Year program for the second time in five years. The plaintiff in the second, related case is identified only as "Midshipman-Y." She alleges that she suffered severe sexual harassment while underway on the same ship as Hicks, one year after the alleged assault. Her complaint alleges that MLL "was complacent about its sexual assault and harassment prevention duties." “But, today, Hope is publicly identifying herself in an effort to seek justice for the sexual assault and harassment that she, and others – like Midshipman-Y, endured aboard Maersk vessels.” In the complaint, she alleges that she was raped by the first engineer on board - after he provided her with alcohol and encouraged her to drink heavily. The first of the plaintiffs, current USMMA senior Hope Hicks, has identified herself for the first time as the well-known "Midshipman-X" - the anonymous sexual assault survivor whose story of underway abuse revived the debate over how to safeguard personal security for cadets.

One woman's anonymous online account of assault last year raised concerns on Capitol Hill, prompting a temporary pause in the program.

According to the suit, for example, the company did not have a system on the Alliance Fairfax to track or restrict the use of master keys. Hicks’ lawyers also submitted a second suit, on behalf of a woman who said she faced sexual harassment and unwanted touching as a cadet aboard the same vessel two years later. The suit alleges that a satellite texting device issued by the U.S. Merchant Marine Academy, which was meant to provide an emergency connection to land, failed to work much of the time. The company said staff have been told “we will not tolerate any breach of our policies regarding the fair treatment of all personnel.” Hicks said she was raped by a supervisor on the M/V Alliance Fairfax in 2019 when she was 19.

Driven to desperation, at the first opportunity, Midshipman-Y begged USMMA representatives to get her off the ship prior to the completion of her required sea time. “What happened to Hope and Midshipman-Y was both foreseeable and preventable by Maersk,” said Steven J. Kelly, Partner at Sanford Heisler Sharp and counsel for plaintiffs. According to the complaint, Hicks suffers from severe and ongoing emotional distress as a result of the traumatic events she experienced on the Maersk vessel. Midshipman-Y’s complaint alleges that she experienced extreme sexual harassment, unwanted touching and discrimination while on board the same Maersk vessel two years later. The USMMA Sea Year Program requires, as a precondition to graduation, that students work on commercial ships for months at a time to gain practical shipboard experience. According to the complaint, when Hicks confronted the officer, she was told no one would believe her if she made a report.

Hicks said members of the crew often looked on as she was sexually harassed by her supervisor on the ship and did nothing to intervene. She woke up the next morning to find blood on her sheets and bruises on her body. Hicks said she suffered some pushback from fellow students who figured out she was the anonymous student who had come forward and worried their Sea Year studies would be affected. Shortly after returning to campus, Midshipman-Y says she became extremely sick from her anxiety — ultimately passing out in the dining hall from a panic attack and being transported to the emergency room via ambulance. Her rape, she said, destroyed the interest she had in pursuing a career as a Merchant Marine engineer. Until it changes it's just going to keep happening," Hicks said, adding that she hopes her lawsuit will give other victims the courage to come forward so that Maersk and other shipping companies will be forced to create safe working environments for female crew members, who are significantly outnumbered in the industry. The Coast Guard investigated the alleged rape as well and referred the case to the Department of Justice, but prosecutors declined to comment on whether charges would be filed, citing the ongoing investigation. But from the moment she stepped on board, Midshipman-Y said she became the subject of sexual comments and jokes from a number of crew members. Even though she knew that cutting her time at sea short could mean she wouldn't be able to graduate, the lawsuit states, Midshipman-Y requested an "emergency evacuation" anyway, the lawsuit states. As detailed in her lawsuit, Midshipman-Y said she didn't feel safe in her room, since other crew members had master keys that could open any room on the ship. "Not only did the senior officials on the Alliance Fairfax not enforce the anti-[sexual assault and sexual harassment] policies, but they were among the offenders," it states. Using the moniker Midshipman-Y, the young woman's account represents the latest blow to the federal academy, which has struggled to protect students from sexual abuse both on campus and at sea, and hold offenders accountable.
